In 2003, Class Counsel for the Thousand Adventures Members filed a Claim in the Bankruptcy of Four Star Financial Services, LLC, a California company which had purportedly been the Holder of Retail Installment Contracts executed by TAI Members in connection with the purchase of their campground memberships.
The Bankruptcy Trustee objected to the Claim. Class Counsel pursued this claim, and although there was little money in the bankruptcy, Class Counsel was able to persuade the bankruptcy judge that the TAI members were entitled to priority claim status which put them at the front of the line. The Trustee appealed the decision but the parties reached a partial settlement which obligated the Trustee to immediately pay to the class $1.5 million pending the resolution of one issue on appeal. An additional $1.3 million remains subject to the outcome of the appeal.
Class Counsel has submitted an application with the Iowa District Court for permission to go ahead with the distribution of this amount.
